Educate your employees on the proper way to greet an inspector.
Give the agent a pre-written note stored near the front door and
call your lawyer immediately. Keep in mind that it is a regulatory
violation for a repair station to refuse to allow the FAA to enter.
You can lose your certificate doing so.
can and do arise. Most often, they are a result
of misunderstandings or an untrained or overreaching individual acting outside their agency's
scope and authority.
WHAT SHOULD I DO?
Whether or not you allow someone access to
your facility depends on the situation, including
who they are, what they want to do and why.
If you know the individual, as in the case of
your local principal maintenance inspector, and
they are reviewing your location as part of their
regulatory routine, then giving them access is
reasonable.
"Most people know you don't have to let a
government agent in unless they have formal
process, such as a warrant," said Jason Dickstein,
general counsel for the Aircraft Electronics
Association. "However, in aviation, as a
condition of your certificate, you are required to
let the FAA enter for certain purposes."
The FAA has broad reach because it is tasked
with a wide variety of functions, including
regulatory, operational and enforcement.
However, there are limits under which the FAA
can enter.
"There are arguments to be made that the
FAA may actually be precluded from entering in
situations where the regulations allow them to
enter," Dickstein said. "If those regulations run
afoul of the Fourth Amendment, then the Fourth
Amendment wins."
For example, if the FAA entered not for safety
purposes, but rather because it's investigating
allegations of criminal activity, then it is possible
that it is an illegal search, according to Dickstein.
In the case of unusual circumstances, when
someone you don't know shows up or the person
seems to be investigating something specific, be
cautious.
"If you have a manufacturing inspection district
office inspector showing up at your repair station
who does no fabrication, then you should probably
be asking a few questions," Dickstein said.

business. Your lawyer can help sort exactly who
the agent is and his purpose, and which experts
you need on hand to answer questions. Having
a lawyer present also tends to calm the situation
