News & Regulatory Updates
19th CARAC plenary session
Transport Canada Civil Aviation played host to
its 19th Canadian Aviation Regulatory Advisory
Council plenary session, Nov. 23-25. The plenary
session typically takes place once a year and is set
up to provide the industry an overview of what has
taken place in the regulatory arena over the last 12
months and what is being planned for the next few
years. It is also an opportunity for the industry to
provide input and help with priority planning. These
sessions took place virtually for three hours each day.
Needless to say, there was not much opportunity to
generate discussions or collect feedback during the
virtual sessions; therefore, the focus became mostly
an update as to what TCCA is doing.
Here are some of the highlights:
* CARAC Modernization
This initiative has come from the many
consultations that have taken place with industry
over the last several years. Additionally, the
government has provided general guidelines
to regulatory development in all departments.
The action plan related to the modernization
consists of modifying and improving the way
TCCA consults with industry; the way TCCA

communicates; the way TCCA engages industry;
and how all information is documented. You
can see some of the changes already in place
on the CARAC website. It was not addressed
how TCCA was to engage at the technical level,
which was done 10 years ago when technical
committees were set up to guide each area of the
regulations. This does not seem to be in the plans.
* Regulatory plans for 2022
There are several dockets open to modify the
regulations over the next year. These include
items such as: changes to training programs
and ATO requirements; changes to the Air
Navigation Services regulations; type design
fee modernization; night VFR operation rules;
RPAS requirements for beyond visual site
flights; lightweight data recorder requirements;
and approach ban requirements. Much of these
have NPAs issued, but there are still some in
consultations.
* 5G Interference
TCCA and other authorities are investigating the
potential issues with the new 5G network. This
new network operates on a similar frequency band
as radar altimeters and has the potential to cause
interference in radar altimeter function. Safety
alerts have been issued in this regard that provide
some recommendations to operate flights safely.
Mitigation is being worked on by several groups
to ensure long-term solutions are put in place.
