The following is from FAA Order 8900.1,
Volume 3 and 14 CFR Part 120.

Question: I have a technician who tested above
the state limit for alcohol on a law enforcement test
conducted when the employee was off duty. Where
should I report this information?
Answer: The understanding of these terms
is fundamental to efficient compliance with the
regulations governing a repair station. As described
in FAA Order 8900.1 Vol 3, Ch 1, Sect 1, a test
conducted by law enforcement is not regulated under
14 CFR Part 120.
With regards to a technician, this is not a
regulatory issue. There is not any guidance
specific to technicians under Part 65 similar to
the language you see for pilots in Part 91 due to
their medical requirements. However, the basic
answer is: " A test conducted by law enforcement
is not regulated under 14 CFR Part 120. "
