HOW DID YOU END UP PRACTICING REAL ESTATE LAW?
I came to Perkins & Anctil, P.C., from a general practice. It was
fairly real estate centered, and I especially liked practicing in the
Land Court. Perkins & Anctil was a good fit for me because it was
similar to what I had been handling, but it also had this whole
other realm of the condominium practice. I found this challenging
and fascinating because it was so client focused and multifaceted.
WHAT'S THE BEST THING ABOUT YOUR WORK?
I like that it is very client centered, and also that it involves me working
on a variety of real estate and contract law matters. If you're living
in a single-family home, the only person you have to ask what you can
do with your property (usually) is yourself. But in the condominium
setting, you're helping many people with various personalities navigate
the challenges of living together as a community. When you're
helping them manage things like repairs or renovations, or understanding
of their governing documents, there can be many moving
parts that touch upon a lot of different areas of the law. I just love that.
WHAT ARE SOME CHALLENGES WORKING
WITH COMMUNITY ASSOCIATIONS?
Sometimes it's hard to act on behalf of a community without letting
personal opinions get in there, that is, balancing the community good
versus certain individuals' desires. That's exactly what board members
are tasked with doing, and I can appreciate how challenging this can
be for them. Making these decisions about where you all live together
is not easy, and people don't always love the results. But associations
do have a set of governing documents that need to be followed.
We help our clients communicate that in a way everyone understands,
which can be difficult, especially if the result isn't favorable.
ONE OF YOUR AREAS OF EXPERTISE IS THE
CORPORATE TRANSPARENCY ACT (CTA).
HOW IS THIS FEDERAL ACT IMPACTING
CONDOMINIUM ASSOCIATIONS?
THE CORPORATE TRANSPARENCY ACT AIMS TO
INCREASE GOVERNMENTAL AWARENESS OF WHO
OWNS BUSINESSES BY REQUIRING THEM TO REPORT
IDENTIFYING INFORMATION. SINCE CONDOMINIUM AND
HOMEOWNER'S ASSOCIATIONS ARE NOT SPECIFICALLY
EXEMPT FROM REPORTING, OUR POSITION HAS BEEN
THAT THEY ARE REQUIRED TO REPORT THEIR BENEFICIAL
OWNERSHIP INFORMATION AT THIS POINT (THOUGH
THERE IS PENDING LITIGATION AS TO THIS QUESTION).
WHEN YOU LOOK AT THE BIG PICTURE, THE GOAL OF
THE CTA IS NOBLE: ASSISTING THE FIGHT AGAINST FRAUD,
MONEY LAUNDERING, AND FINANCING TERRORISM.
BUT ON THE ASSOCIATION AND PERSONAL SIDE,
MANY PEOPLE ARE NOT COMFORTABLE DISCLOSING
IDENTIFYING INFORMATION TO A THIRD PARTY. FOR
CONDOMINIUM ASSOCIATIONS, THERE CAN ALSO BE
CONFUSION OVER WHO EXACTLY HAS TO FILE. TYPICALLY,
IT'S JUST THE BOARD MEMBERS [OR OWNERS WHO
HAVE MORE THAN A 25% BENEFICIAL INTEREST IN THE
ASSOCIATION] WHO NEED TO PROVIDE THEIR PERSONAL
INFORMATION. ASSOCIATIONS ARE IMPACTED GREATLY
BY THE CTA BECAUSE BOARD POSITIONS CHANGE ALL
THE TIME, AND EVERY TIME THEY DO, YOU HAVE TO FILE
AN AMENDED REPORT. COORDINATING FILING AND
HANDLING PUSHBACK FROM INDIVIDUALS CONCERNED
WITH THEIR PRIVACY IS AN EXTRA HURDLE FOR
VOLUNTEERS WHO ARE ALREADY VERY BUSY.
