DAIRYUPDATE BSE trial forges ahead The class action lawsuit filed on behalf of cattle producers has been given the green light T he BSE class action lawsuit filed on behalf of dairy, beef and veal producers across Canada against the federal government can now go to trial. On Jan. 22, Justice Janet Wilson of the Ontario Divisional Court denied the federal government’s appeal of the lawsuit certified by Justice Joan Lax in September 2008. “There has already been a delay of three years due to procedural challenges. It is in the interests of justice that this case proceed,” says Cameron Pallett, lead counsel of the lawsuit. “I am confident the government will be prompt now that the appeals process is exhausted.” The class action lawsuit, first launched in 2005, is seeking up to $10 billion in compensation from Ottawa for losses producers suffered as a result of BSE. Filed on behalf of 115,000 Canadian cattle producers, except those in Quebec, the class action suit includes damage claims for past, present and future income losses, lost business opportunities, devalued livestock and cattle business, and devalued real estate, Justice Lax noted in her written decision, released last September. Canadian cattle producers are seeking up to $10 billion in compensation for losses resulting from BSE fallout. 8 | March 2009 | MilkPRODUCER
