An Update on Legal Changes

n 2014, Corestone Law became counsel to OSPE and
we regularly wrote articles for the Voice. In 2016, our
focus turned to facilitating specialized seminars
for our members. However, I still regularly run into
members who recognize me from the articles and
provide positive feedback. As such, I have committed to
provide members with quarterly articles this year on legal
topics relevant to engineers. As some time has passed since
the last article, a good start would be a brief summary of the
legal changes that have occurred since the last article:
Alternative Low-Carbon Fuels Regulation,
Environmental Protection Act - on April 13, 2015, this
regulation codified that a written carbon dioxide emission
intensity report must be prepared by a licensed engineering
practitioner. The regulation further provides details to be
included for the report and approval process.1
Regulation on Performance Standards, Professional
Engineers Act - on July 1, 2016, the performance standards

for tower crane inspections were included in this regulation,
which notes that the Professional Engineers of Ontario (PEO)
has published a document entitled "Review of Tower Cranes
as Required by the Occupational Health and Safety Act". The
document is available on PEO's website.2
Bill 177, Stronger, Fairer Ontario Act (Budget Measures) - on
December 14, 2017, Bill 177 was passed, and this bill implemented
changes in several statutes which include the Professional
Engineers Act, Building Code Act and the Occupational Health
and Safety Act. The changes were motivated by the Algo Centre
Mall Collapse and Elliot Lake Commission.3
* The Professional Engineers Act - the changes were aimed at
improving public safety through greater transparency and
accountability. The changes include providing PEO with the
power to create and regulate continuing education and penalties
for non-compliance; to refuse, suspend or revoke a license based
on specific grounds; clarified PEO's jurisdiction over those
individuals and companies whose licenses have been cancelled,
