ADVOCACY IN ACTION
ENGINEERS CALL ON ATTORNEY
GENERAL'S OFFICE TO MAKE CHANGES
TO PROFESSIONAL ENGINEERS ACT
On October 4, 2021, OSPE's Professional Engineers Act
Working Group (PEAWG) sent its first submission to the
Attorney General regarding suggested chanwges to the
Professional Engineers Act.
Recommendations include:
Regulatory Focus Recommendation: Amend Section 2
Rationale:
* Does not provide sufficient direction and constraint
on how PEO should govern practitioners and regulate
engineering
* External Regulatory Review noted that PEO has too
many committees that provide no benefit to regulatory
purpose
Cease Regulating the Consulting Engineer Title
Recommendation: Repeal Section 7(1)23 and amend
regulation 941 to revoke Sections 56-71 inclusive
Rationale:
* The " consulting engineer " designation framework does
not provide public interest protection beyond what is
already provided by the P.Eng. licence for individuals
and the Certificate of Authorization for engineering
businesses
* Ontario is the only jurisdiction to regulate this title,
causing adverse impacts to labour mobility and adding
to red tape burden

Backstopping PEO Accountability through Ministerial
Action Recommendation: Amend Section 6
Rationale:
PEO has been informed repeatedly that it needs to make
changes to regulations in order to be effective, especially
related to licensing requirements and processes, through
reports like:
* The External Regulatory Review
* The Office of the Fairness Commissioner reports
* The Elliot Lake Commission of Inquiry
* The Coroner's Inquest from the Radiohead stage collapse
* The recent Anti-Racism and Anti-Discrimination Report
Time Limits for Licence Application Processing
Recommendation: Amend Section 14
Rationale:
* External Regulatory Review found licensing and
registration processes are main weakness in PEO's
overall performance, namely transparency, subjectivity,
bias, fairness, and a lack of rigour
* Extensive backlog of applications for licensure
impacts international engineering graduates (IEGs)
disproportionately due to the one year of Canadian
experience requirement
