sheet piles. Scuba Shack contended that the geotechnical
report warned against not only compaction equipment, but
any vibratory equipment, including vibratory hammers.
The court determined that Scuba Shack offered no
evidence to show that the driving of sheet piles caused the
alleged building damage. Furthermore, the court determined
that the warning in the geotechnical report was limited to
compaction equipment, not vibratory equipment generally.
Accordingly, the court held that " Scuba Shack did not come
close to making the required showing that appellants were
grossly negligent. " Accordingly, the developer/contractor
could not be sued for punitive damages.
Again, it is not clear from the published decision, but it
does not appear that, in offering evidence to support gross
negligence, Scuba Shack focused on, or otherwise highlighted,
the fact that the geotechnical engineer recommended drilled
foundations rather than driven piles. It is possible that the
court would have allowed the punitive damages claim, had
Scuba Shack's expert rendered an opinion that the selection of
drilled foundations, taken with the other warnings, made it
clear to the contractor that it should not (1) drive piles; and or
(2) use vibratory equipment generally.
The takeaway: a lack of a full understanding of geotechnical
construction equipment, means and methods can affect
your liability.
