INDUSTRY DEVELOPMENTS State by State Illinois Roughly 200 marijuana operators signed a petition asking Illinois regulators to alter a policy that prohibits adult-use store owners with conditional licenses from selling equity in their businesses until they are eligible to begin retail sales. The business owners who signed the petition complain that the state's policy prevents them from selling shares of their business to investors to raise capital. The Illinois Department of Financial and Professional Regulation crafted the policy in question ostensibly to prevent minority cannabis business owners from selling their licenses to larger, nonminority owned business. Social equity applicants are those with past minor cannabis convictions or who come from areas with high levels of poverty or marijuana arrests. Kentucky A state judge has sided with the Kentucky hemp industry over law enforcement, ruling that products containing delta-8 THC derived from hemp are legal, a trade association said in a news release. The Kentucky Hemp Association, which sued the state over the issue a year ago, celebrated the ruling as " a huge win for farmers and retailers. " Police had begun raiding licensed Kentucky hemp shops to crack down on the delta-8 THC market. The enforcement stemmed from the state Department of Agriculture releasing a letter that referred to delta-8 THC hemp products as a " Schedule 1 controlled substance, " illegal under U.S. law, despite the federal legalization of hemp in 2018. The Kentucky Hemp Association then sued the department, the state agriculture commissioner and the state police commissioner to halt the raids.
