Florida
Gov. Ron DeSantis vetoed a bill that would have effectively outlawed many popular
hemp-derived products in the market.
Passed by the state Legislature in March, Senate Bill 1698 would have limited the amount
of hemp-derived delta-9 THC allowed in products to no more than 5 milligrams per serving
or 50 milligrams per container.
The measure also would have:
* Closed a so-called " loophole " by redefining total delta-9 THC concentration under state
law to also include THCA, a naturally occurring, nonintoxicating cannabinoid that becomes
psychoactive THC when heated.
* Prohibited " any quantity " of " synthetic cannabinoids, " including delta-8 and delta-10 THC.
The Florida hemp industry aggressively lobbied DeSantis to veto the bill, including buying
billboard space near the governor's mansion, according to Politico. Many states have taken
action to regulate hemp-derived products or, in the case of 12 markets, ban delta-8 THC
outright.
Kentucky
State regulators will implement a lottery system to award the first medical marijuana business
licenses.
The lottery will be held in October, Gov. Andy Beshear announced, and applicants will have
to clear a screening process before applying for one of the state's limited licenses, according to
the Associated Press.
In the initial round, the state will issue 48 medical marijuana dispensary licenses, which will
be divided equally among 11 regions of the state, the AP reported.
Beshear also signed a bill that allows medical cannabis operators to apply for business
licenses as early as July. House Bill 829 contains several restrictions that could stymie growth
and expansion, however, including:
* Bans on smoking medical marijuana.
* Allowing opt-outs for local governments to restrict MMJ businesses.
* Prohibiting outdoor marijuana cultivation.
* Allowing religious private schools to refuse to enroll MMJ cardholders.
Louisiana
The Republican-led state Legislature sent a bill to Gov. Jeff Landry that would transfer the
state's two medical cannabis cultivation licenses from public universities to private companies.
Senate Bill 228, sponsored by Sen. Patrick McMath, easily passed through the Legislature
and stands to overhaul the state's limited-license market. Under the state's rare model, the
two medical marijuana cultivation licenses allowed by law have been held by Louisiana State
University and Southern University since the program debuted in 2015.
If Landry signs the bill, those licenses will be transferred to the universities' contractors,
Good Day Farm and Ilera Holistic Healthcare. Good Day and Ilera pay the universities and the
Louisiana health department more than $1 million annually in contracting and licensing fees,
The Times-Picayune reported.
