Mandated Reporting
Minnesota law mandates reporting maltreatment of
minors to Child Protection Services in the county
where the alleged abuse occurred when there is reason
to believe child abuse or neglect is happening or has
happened within the last three years. Minnesota law
also mandates reporting when someone has reason
to believe, that a vulnerable adult has been or is being
abused, neglected, or exploited and must immediately
report such knowledge or suspicion to the Minnesota
Adult Abuse Report Center (MAARC). Professional
staff at Hazelden Betty Ford Foundation are mandated

reporters, and staff will follow reporting requirements
as defined by Minnesota law. If you have questions
regarding these laws or are aware of information you
believe may be reportable, please ask your assigned
clinician.
Maltreatment of vulnerable adults
Suspected maltreatment of vulnerable adults will be
reported if:
* There is suspected abuse, neglect, and/or financial
exploitation
* The individual is assessed as being a vulnerable
individual in a residential setting or a functionally
vulnerable individual in an outpatient (nonresidential)
setting
* There is a consent authorizing the ability to report.
A mandatory reporter need not make a report under
State law where a Federal law specifically prohibits a
report, unless the vulnerable adult, guardian or legal
representative has consented to the disclosure in
conformation with the Federal requirements.
What Must Be Reported:
That a vulnerable adult is being or has been maltreated,
or that a vulnerable adult has sustained a physical
injury, which is not reasonably explained.
Who is a Vulnerable Adult?
1. Persons 18 years of age and older who are receiving
residential SUD services are considered categorically
vulnerable.
2 Persons 18 years of age or older who are receiving
outpatient (non-residential) SUD or mental health
services are not considered categorically vulnerable
but may be functionally vulnerable. The individual
receiving outpatient service is vulnerable if they
possess a physical or mental infirmity or other
physical, mental, or emotional dysfunction:
* That impairs the individual's ability to provide
adequately for the individual's own care without
assistance including the provision of food, shelter,
clothing, health care, or supervision; and
* Because of the dysfunction or infirmity and the
need for assistance, the individual has an impaired
ability to protect themselves from maltreatment.
