be far better were the Court to be renamed "Fiduciary
Court."2 After all, fiduciary relationships are broadly what
this court is all about; the application and enforcement
of principles of quity, loyalty, trust, and integrity. Those of
us who are fortunate enough to be associated with this
fiduciary court - judges, attorneys, professional as well as
lay guardians, medical experts, social workers, and others
- have the wonderful opportunity to work toward creation
of just results for those who need care and protection.
In the 21st century, unlike what was true in 17th century
England 18th century America, orphans are but a small
subsection of those who seek justice in this division of
our courts. The time to rename "Orphans' Court" is well
past due. As has often been stated, we should not reject
wisdom just because it comes late.

I recognize that changing the name of Orphans' Court would require
amending various state statutes and state and local rules, along
with changing the longstanding habits of many veteran judges and
attorneys. This brief commentary is limited to initiation of the name
change conversation; there is no intent to address the logistics of how
such a name change can be implemented.

Many people whom I have informally polled, who favor a name
change, believe that the new name should be "Probate, Estates, and
Fiduciary Court" (i.e., "PEF Court"), thereby tracking the statutory
scheme which applies to many of the issues addressed in Orphans'
Court. In response, I would suggest that "Fiduciary Court" has two
benefits: the name more accurately applies to non-PEF Code as well as
PEF Code Orphans' Court duries, and it is short and to the point.
