adoption of a new hazard category for non-flammable aerosols
and new subcategories for flammable gases, and modifications
to Schedule 1 of the HPR to update the information elements
required for safety data sheets (SDS). In addition, Part 1 of
Schedule 5 of the HPR adopts a new physical hazard class,
Chemicals Under Pressure, from GHS Rev 8. Health Canada
has also modified the regulatory proposal to provide a threeyear
transition period after many stakeholders including CPCA
expressed concern with the initial short two-year period.
CPCA participated in previous extensive consultations with
Health Canada prior to the adoption of GHS Rev 7 and submitted
comments after the Canada Gazette Part I publication in 2021.
CPCA identified specific variances deemed most problematic
for industry, and contributed to further detailed consultations
on sub-sections of the amendments such as combustible dusts,
chemicals under pressure, and Section 5.12 on significant new
data.
The regulatory amendments will impose costs on suppliers
who sell or import hazardous products intended for use,
handling or storage in Canadian workplaces. The total national
cost to Canadian businesses was estimated at $53.8 million.
However, there is a large degree of uncertainty in this estimate
owing to the small sample size and the variability in identified
impacts by individual businesses. For Canadian suppliers who
sell products in both Canada and the U.S., these costs would
have been incurred anyway, regardless of the amendments to
the Canadian regulations, given the U.S. adoption of the seventh
revised edition.
OSHA's final ruling is expected in the first half of 2023 and

it is hoped that the implementation timelines will be consistent
with those of Health Canada, as alignment on regulations with
the United States was the greatest concern raised by industry
during the consultation process.
Government Shares List of 850+ Substances to
be Included in Upcoming Section 71 Information
Gathering Notice
At the recent CPCA Paint and Coatings Working Group (PCWG)
meeting held on December 1, 2022, Government officials
provided an update on the standard information gathering plans
under Section 71 of CEPA for mandatory data gathering in 2023
and beyond. Going forward, Section 71 notices will be issued
annually using a standard format focusing on core data needs
with approximately 855 substances targeted in the first round.
Information on substance quantities, use information, function,
concentration, and facility information will have to be provided
by industry. This will require significant engagement by CPCA
members and all those in the CASE industry in Canada.
CPCA has been urging members to take note of the new
standardised annual approach to information gathering
required under Section 71. The draft list of 855 substances is
available now but is still subject to change and more details
are provided for CPCA members. Although the Notice will be
followed by a six-month implementation period starting in May
2023, companies are encouraged to review the list now and start
preparing their company's response to the 'mandatory' Section
71 survey as soon as possible, as it could be long and timeconsuming
to respond to the proposed survey format.
