CPCA CORNER
Limits for Certain Products Regulations " were published in the
Canada Gazette, Part II: Vol. 156, No. 1. The regulations apply to
manufacturers and importers and establish VOC concentration
limits and emission potentials for the manufacture and import
of over 130 categories and subcategories of products. The
manufacture and import of products with VOCs in excess of
their respective category-specific limits is prohibited unless
a permit is obtained. The types of products covered include
personal care products; automotive and household maintenance
products; adhesives, adhesive removers, sealants and caulks;
and other miscellaneous products.
The Regulations applying to the products listed in the
schedules to the regulations will come into effect on January
1, 2024, for all product categories, except disinfectants, which
come into effect on January 1, 2025. Government will attempt to
promote compliance through the development and distribution
of promotional materials (e.g. fact sheets, website material) to
explain the provisions of the new Regulations. CPCA will work
with Government to ensure that the appropriate information is
available to the regulated community.
Ongoing Chemicals Assessment Activities Under
the CMP
The ongoing risk assessment of chemicals in commerce
continues under the federal Chemicals Management Plan
(CMP). CPCA monitors substances implicated in paint, coatings,
sealants, and adhesives and updates members on regulatory
actions via our digital platform, the Canada Coatings HUB and
regular bulletins to members.
Several draft screening assessments (DSAR) were published
since the beginning of the year, some with possible implications
for the coatings sector. The DSAR for the " Select Hydrocarbon
Based Substances " group came out in January and proposes that
the 8 substances surveyed do meet any toxicity criteria under
CEPA, 1999. The DSAR for 34 Substances Identified as Being of
Low Concern was published for a 60-day public comment period.
The substances in this group pose low risk to human health
and the environment but are widely used in various chemical
manufacturing industries. No follow-up risk management
actions are expected.
Final decisions after the initial screening assessment were
published for benzoxazole, 2,2'-(1,4-naphthalenediyl)bis(fluorescent
brightener 367), CAS RN 5089-22-5 and nonane,
2,2,4,4,6,8,8-heptamethyl- (heptamethylnonane; HMN), CAS
RN 4390-04-9. Both substances were identified as priorities for
assessment as they met categorization criteria under subsection
73(1) of CEPA. It was concluded that neither substance meets
any of the criteria set out in section 64 of CEPA.
Lastly, a final decision after the initial screening assessment
was published for 1-nitropropane (CAS RN 108-03-2), a known
CASE ingredient. This substance was considered a priority based
on human health concerns. It was concluded that 1-nitropropane
does not meet any of the criteria set out in section 64 of CEPA,
1999. 1-nitropropane is known to be used in paints and coatings
and as a solvent in markers and cosmetic nail brush cleaners.
CPCA is pleased with this outcome which ensures that the CASE
industry still has access to this substance.
