Requirements for Consumer Products
O
n July 11, Health Canada moved forward with a
proposal to introduce new requirements under
the Canadian Consumer Product Safety Act
(CCPSA) as many consumer products have been
linked to Human Health Hazards of Concern (HHHOCs)
such as carcinogens, mutagens, and reproductive toxicants.
This proposal will introduce new requirements for the
classification criteria of HHHOCs including information
disclosure and to secure additional protection for consumers.
Three regulatory options are being considered such as
amending the existing container regulations (CCCR, 2001),
issuing a new regulation under the CCPSA or an alternative
approach to replace the CCCR, 2001 with a risk-based GHS
framework. Whatever is chosen, industry must be fully
engaged as this Notice of Intent moves forward in the coming
months as it will impact many sectors including the CASE
sector.
Federal Government Publishes Draft 'Federal
Environmental Quality Guidelines' (FEQG)
These guidelines target Benzene, Toluene, Ethylbenzene and
Xylene (BTEX) and all three substances are used in the CASE
industry. These draft guidelines provide recommendations
in both quantitative or qualitative terms to support ongoing
federal environmental quality monitoring. In the Resource
section on Canpaint.com, a fact sheet is provided outlining
how they plan to protect aquatic life from adverse effects of
BTEX substances, which will apply to both freshwater and
marine environments.
Final Amendments for the 'Conventions
Regulations'
'Conventions Regulations' amendments expand the list
of offences contained in existing regulations under the
Canadian Environmental Protection Act related to enhancing
the Migratory Birds Regulations (MBR), providing federal
enforcement officers with an appropriate enforcement tool.
Among the 46 new offences added to the MBR are several
related to the existing Third VOC Regulations for Certain
Products and the Single-use Plastics Prohibitions, both with
'Conventions Regulations' amendments expand the list of offences
contained in existing regulations under the Canadian Environmental
Protection Act related to enhancing the Migratory Birds Regulations
(MBR)
implications for the CASE sector in Canada. The fine amount
for each offence is $500.
Health Canada Forms Working Group on
Benzophenone
Health Canada is in the process of establishing a Working
Group with the intent of developing a Code of Practice instead
of a regulation for Benzophenone. CPCA met with officials in
July on a recommendation for a maximum benzophenone
concentration limit for interior and exterior paint, stain
and/or coating products that are available to consumers in
Canada. CPCA member companies with a stake in those
products (e.g. sales, manufacturing, development, production,
etc.) continue to contribute to the development of the Code of
Practice.
