Le sort du logement/attribution préférentielle
Le concubin ne bénéficie pas de l'attribution préférentielle du logement,
c'est-à-dire qu'il ne peut bénéficier prioritairement de la propriété du
logement lors du partage des biens du concubin décédé. Chacun des
concubins peut cependant léguer à l'autre sa part dans les biens constituant
le logement (qui sera soumis au paiement de droits de mutation
de 60 %). Il existe également diverses techniques juridiques qui permettent
aux concubins d'acheter ensemble un bien qui pourra être conservé
par le survivant en réduisant les taxes liées à la mutation (tontine, etc.).
Les prestations sociales et familiales liées au décès
Si l'assuré décédé avait des personnes à sa charge effective, totale et
permanente, le capital décès est versé à ces personnes à charge, considérées
comme bénéficiaires prioritaires, dans un certain ordre de priorité.
Le concubin ne percevra ce capital qu'à défaut de conjoint, de partenaire,
d'enfants et d'ascendants (parents ou grands-parents) à charge.
Le concubin survivant ne peut être bénéficiaire ni de l'allocation veuvage,
ni de la pension de réversion.
Les droits liés au décès accidentel
Lorsqu'un tiers provoque la mort d'un concubin, son compagnon survivant
peut demander réparation à la personne responsable de l'accident
pour le préjudice (matériel et moral) subi à raison de son décès.
Désormais, en cas d'un accident du travail, le concubin survivant perçoit
une rente (40 % du salaire annuel du concubin décédé) dès lors qu'il
peut faire la preuve que la situation de concubinage était établie avant
la date de l'accident du travail ou, à défaut, qu'elle l'ait été depuis au
moins 2 ans à la date du décès de l'assuré. Ces conditions ne sont pas
exigées si les concubins ont eu un ou plusieurs enfants communs.
