SCI ET RÉSIDENCE PRINCIPALE
La résidence principale dans une SCI fait perdre l'abattement de 30 %
en matière d'impôt sur la fortune immobilière (IFI).
Elle fait également échec au droit au logement gratuit durant une année
pour le conjoint survivant au décès de l'un des époux.
Elle fait perdre à l'entrepreneur individuel, l'insaisissabilité de sa résidence
principale prévue par les articles L. 526-1 et L. 526-2 du Code
de commerce.
Lors d'une succession, un abattement de 20 % peut être pratiqué sur
la valeur vénale réelle de l'immeuble constituant, au jour du décès,
la résidence principale du défunt, lorsque, à la même date, cet immeuble
est également occupé à titre de résidence principale par le
conjoint survivant, par le partenaire lié au défunt par un Pacs, ou par
un ou plusieurs enfants mineurs ou majeurs protégés du défunt, de
son conjoint ou de son partenaire (CGI, art. 764 bis ; BOFIP-ENRDMTG-10-40-10-30-§
10-12/09/2012). Cet abattement ne s'applique
pas lorsque l'immeuble est détenu indirectement par l'intermédiaire
d'une SCI dont il est associé (BOFIP-ENR-DMTG-10-40-10-30-§ 4012/09/2012).
À
noter également que lors de l'acquisition de parts sociales d'une
SCI, sauf clause prévue dans le protocole, l'acquéreur ne peut bénéficier
lors de la promesse d'achat, du délai de rétractation de 10 jours.
Toutefois sur le plan fiscal, l'associé d'une SCI qui occupe sa résidence
principale, propriété de cette SCI, bénéficie de l'exonération de
plus-value, comme s'il était propriétaire en direct.
