LA TVA EST EN PRINCIPE DÉDUCTIBLE POUR L'ENTREPRISE
ASSUJETTIE QUI EST UN CONSOMMATEUR INTERMÉDIAIRE
La TVA d'amont, qui a grevé les éléments du prix d'une opération imposable,
est déductible de la TVA d'aval, facturée sur cette opération. Ce système vise à
garantir pour l'entreprise la neutralité de la TVA, supportée en définitive par le
consommateur final. Il est nécessaire d'être un assujetti agissant en tant que tel
pour pouvoir déduire la TVA.
LA DÉPENSE DOIT EN PRINCIPE ÊTRE RÉALISÉE EN VUE
D'OPÉRATIONS IMPOSABLES À LA TVA
Les biens ou services dont on souhaite déduire la TVA doivent être utilisés pour
la réalisation d'opérations imposables à la TVA : il y a un lien direct et immédiat
entre la dépense et l'opération imposable. La dépense peut être réalisée au titre
des frais généraux.
CERTAINES OPÉRATIONS EXONÉRÉES OUVRENT CEPENDANT
DROIT À DÉDUCTION (CGI, art. 271)
Les opérations ouvrant droit à déduction sont en principe des opérations qui
sont effectivement soumises à la TVA. Les opérations qui ne sont pas dans
le champ de la TVA, ou qui sont exonérées, n'ouvrent en général pas droit à
déduction. Des exceptions sont prévues pour certaines opérations, comme les
exportations ou les livraisons intra-communautaires, qui sont traitées comme
des opérations soumises à la TVA pour les besoins du droit à déduction.
LA DÉDUCTION DE LA TVA PEUT ÊTRE PARTIELLE SELON
L'AFFECTATION DU BIEN OU DU SERVICE
Le bien ou le service concerné est parfois affecté simultanément à une opération
imposable et à une opération non imposable ou hors du champ d'application
de la TVA. Cela limite sa déduction pour les redevables.
LA DÉDUCTION EST SOUMISE À DES CONDITIONS
GÉNÉRALES
La déduction de TVA, exigible chez le fournisseur, n'est possible que si les biens
ou services concernés remplissent les conditions suivantes :
- ils sont utilisés pour les besoins d'une opération économique réalisée à
titre onéreux et ouvrant droit à déduction ;
- ils sont nécessaires à l'exploitation et engagés dans l'intérêt de l'exploitation
;
- il doit s'agir de biens ou de services dont la déduction n'est pas interdite
par une disposition légale ;
