Working Time and Work Intensity in Portuguese Courts

Cet article analyse les conditions de travail des greffiers, procureurs et
juges au Portugal, sur la base des résultats d'une enquête par questionnaire
en ligne et d'entretiens, dans le cadre du projet de recherche QUALIS. Il
se concentre sur les temporalités et l'intensité du travail des professions
judiciaires au Portugal. Les résultats montrent que les personnels des
tribunaux portugais travaillent à un rythme soutenu et en dehors des
heures réglementaires pour accomplir une charge de travail lourde dans
des délais très serrés. Leur environnement de travail se caractérise par
ailleurs par des espaces exigus, avec un mobilier et des ressources technologiques
inadéquates. Ces conditions de travail sont perçues, ou vécues,
comme inévitables, prévisibles, et normalisées. Cette contribution invite à
prendre en considération ces résultats pour améliorer les performances
des tribunaux et la qualité de la justice rendue aux citoyens.

This article examines working conditions among court clerks, public
prosecutors, and judges in Portugal, based on the results of an online
questionnaire and interviews, developed at the research project QUALIS.
It focuses on two dimensions of working conditions: working time and
work intensity. The results show that Portuguese judicial professionals
work at a high pace and outside regular hours to achieve a heavy workload
to tight deadlines. These working conditions are seen, or experienced, as
inevitable, to be expected, and normalized. This article invite to take into
consideration these results in order to improve the performance of courts
and the quality of justice provided to citizens.
