environment and data protection) and the Charter of Fundamental Rights of the
European Union (Article 31: Fair and just working conditions). More recently, the
European Union also promoted an assessment of the implementation, by member
states, of Directive 2003/88/EC concerning certain aspects of the organization of
working time.22 While concluding that the compliance of member states with the
directive's requirements is improving, this report also highlighted the existence
of a diverse range of problems, such as the incorrect transposition of the requirement
to provide compensatory rest, " treatment of on-call time as working time,
limitations to maximum working time for specific groups of workers (mainly
healthcare personnel and armed forces), and limitations to working time for night
workers. " 23 Several of these dispositions also apply to the labor context of courts
in Portugal, as can be seen in the following sections.
As mentioned in a recent state-of-the-art article,24 studies on the working
conditions within the legal, particularly the judicial, professions are quite scarce
and have mainly been centered on professional satisfaction25 and/or issues of
professional identity.26 Working conditions have been a frequent object of study
in other professions, such as doctors and nurses, as well as at-risk professions
like police officers and firefighters, but mostly from a psychological or psychiatric
perspective. Thus, for example, studies have recently been carried out on the
working conditions of a number of Portuguese professions, in which a combined
methodology was used for evaluating the working conditions and the burnout of
dockers,27 civil aviation flight personnel,28 and high school teachers.29
