III. Working Time and Work Intensity of Judicial Professionals
In this section, working time and work intensity of the judicial professions will be
analyzed using the conceptualization described in Section 1, based on the applied
questionnaire and interviews. Work intensity and working time are two of the
seven dimensions of the job quality framework proposed by EUROFOUND, which
permits the evaluation of their impact on workers' health and well-being. Work
intensity is related to the level of work demands, while working time comprises
duration, atypical working time, working time arrangements, and flexibility.
These two dimensions are especially appropriate for judicial professions, playing
an important role in their health and well-being as well as in their performance.
Portuguese judges and public prosecutors have greater flexibility in terms of
work arrangements than court clerks. On the one hand, judges and public prosecutors'
statutes do not oblige compliance with a specific timetable, although
the 35-hour, civil service workweek applies to them on a subsidiary basis. Court
clerks, on the other hand, are bound by the opening hours of courts as set out in
Ministerial Order 307/2018, from 9 a.m. to 12:30 p.m. and from 1:30 p.m. to 5 p.m.,
with public services closing at 4 p.m. on business days. Furthermore, even though
judges and public prosecutors must carry out their duties primarily in court, they
may, however, whenever their duties do not require their physical presence, and
provided that proceedings are not affected or disrupted, work outside of court
buildings.
In the following sections, we present descriptive statistics of the item responses,
followed by working time and work intensity aggregated values or indexes concerning
sex, profession, judicial district court, respondents' areas of legal practice,
and respondents' place of work.
III. 1. Working Time: Doing what the Job Requires
Table 2 shows that all items of the working time index present a mean value above
the midpoint of the response scale (2.5 in a 5-points scale) and that the global
mean of working time is 3.06. Although it shows a relevant value for the need to
work extra hours (duration dimension), the working time index does not generally
provide a disturbing result, with a high impact on the performance of the judicial
professions. Nevertheless, this global conclusion does not mean that there are
no internal discrepancies in the results, in connection with different variables:
courts, specific services or legal areas within the court, profession, among others.
