job always comes first. " Hence the long working hours, the multiple time arrangements
aimed at satisfying the demands of the profession, and the need to have
highly flexible schedules in order to meet deadlines.
The second conclusion pertains to the high work intensity that is necessary not
only to meet the deadlines but also to achieve the productivity levels imposed by
the High Councils, which is a core element of professional evaluation, with a major
impact on one's career advancement. The weight of numbers-annual quantitative
evaluation-is fundamental for the professional activities performed by judges,
public prosecutors, and court clerks and of the judicial system. To work at a high
pace is considered normal. Its articulation may vary among the professionals
involved, the volume and characteristics of proceedings and the goals defined by
the management bodies. The pressure to achieve good statistics is, therefore, an
important determinant of the professional strategies, with several ramifications
for work intensity, and, consequently, on burnout.
The third conclusion is the diverse nature of the judicial system in terms of
working conditions. There are clear differences for working time and work intensity,
according to profession and court. The statistical data clearly shows that
judges work more extra hours and court clerks work with more intensity, with
public prosecutors scoring medium values. At the same time, there are relevant
differences among the judicial district courts, with the worst results for working
time being scored in Madeira, Setúbal and Aveiro, and Lisboa Norte, Porto Este
and Faro scoring worst in the case of work intensity. Conversely, the best results
come from smaller courts or from courts with a high concentration of resources
(in terms of both facilities and human resources, as is the case with Coimbra).
The results obtained must be taken into account by any comprehensive approach
to court management aimed at improving the quality and efficiency of justice.
More specifically, there is the need for courts to adopt the framework on Health
and Safety at Work that is already mandatory for other public services yet remains
to be fully implemented in the judicial system. This must be complemented with
the definition, adoption, and implementation of new models of court management
that are based on a thorough assessment and with the necessary allocation of
resources (human, financial, and in terms of facilities). Providing better working
conditions to judicial professionals is a major guarantee that high-quality justice
will be delivered to citizens.
