consultatif, il préfigure une future CNIL européenne. Il est composé de
représentants des autorités administratives indépendantes nationales, de
la Commission européenne et du Contrôleur européen de la protection
des données.

B. La concrétisation de l'exigence d'un contrôle indépendant
Alors que le contrôle judiciaire est le symbole du contrôle indépendant,
l'exigence de contrôle indépendant prévue par les textes a été interprétée
comme permettant l'installation d'une autorité administrative indépendante
chargée du contrôle des fichiers. La Commission nationale de l'informatique et des libertés ayant été créée en 1978, elle a à cet égard servi de
modèle pour l'installation d'autres autorités en europe. La Cour de justice
européenne a toutefois dû préciser cette notion d'indépendance qui a été
interprétée de façon très aléatoire par les pays membres.
Par exemple, dans l'affaire Commission c/ Allemagne16, il apparaissait
que l'Allemagne avait placé sous la tutelle de l'État les autorités de contrôle
compétentes en matière de traitement des données à caractère personnel
par le secteur non public dans les différents Länder. La Cour souligne que
les autorités de contrôle sont « les gardiennes » des droits liés au traitement
de données à caractère personnel garantis dans la directive et que leur
installation dans les États membres est considérée « comme un élément
essentiel de la protection des personnes à l'égard du traitement des données
à caractère personnel ». La Cour conclut donc que « lors de l'exercice de
leurs missions, les autorités de contrôle doivent agir de manière objective
et impartiale. À cet effet, elles doivent être à l'abri de toute influence extérieure, y compris celle, directe ou indirecte, de l'État ou des Länder, et pas
seulement de l'influence des organismes contrôlés ». L'indépendance peut
notamment être interprétée comme l'absence de supervision ou d'instructions par l'État. La Cour a donc considéré que les institutions allemandes
chargées de la protection des données au niveau des Länder n'étaient pas
suffisamment indépendantes pour contrôler le traitement de données à
caractère personnel par des organes non publics, au motif qu'elles étaient
soumises à la tutelle de l'État.
De même, dans l'affaire Commission c/ Autriche (16 octobre 2012),
la Cour doit apprécier le statut de certains membres et du personnel de
l'autorité autrichienne de protection des données (commission de protection des données, « Datenschutzkommission - DSK »). Pour la Cour,
