Twenty-five percent of responding boards
(9) indicated that enforcement of the state
Controlled Substances Act (CSA) fell solely
under the board, while nearly 18% (6)
reported that federal CSA fell solely under
board purview. Eleven boards reported
issuing controlled substances (CS) licenses
to pharmacy licensees, while 10 reported
processing renewals. Nine boards reported
issuing CS licenses to non-pharmacy
licensees, as well as processing renewals.
Fiscal Information
Thirty-four boards provided information
about fiscal functions they perform. Of
the responding boards, at least 19 reported
that they are responsible for one or more
of the following:
* setting fines (26) and fees (23);
* collecting fines (19) and fees (24); and
* making purchasing decisions (22).

Only 19 of the responding boards
reported that they were responsible for
developing the board of pharmacy's budget.
Of the 34 boards that responded to the
question, all but two have the ability to impose
fines for infractions of laws or regulations. The
maximum fine amount the boards could levy
starts at $100 per violation, with some states
imposing no limit.
Nine respondents reported that other state
agencies (such as the state department of
health, state attorney's office, or drug control
agency) could impose fines for infractions
of pharmacy or wholesale drug distributor

laws or regulations; nearly 73% reported that
other agencies could not impose such fines.
About 44% of the 34 responding boards
reported that their budget was fixed by
legislative appropriation, a 9% decrease from
2021; nearly 56% reported that the budget
was not fixed.
Twenty-nine boards provided
information on their 2022 budgeted
expenditures. Of these,
* 5 boards reported budgeted expenditures
under $1 million;
* 19 boards reported budgeted expenditures
between $1 million and $5 million; and
* 5 boards reported budgeted expenditures
over $5 million.
Twenty-five states provided some details
on their revenue sources. Of these, 21
states reported that anywhere from 64%
to 100% of their budgeted revenues were
derived from permit or license fees, with
five boards reporting that all of their
budgeted revenue came from this source.
Other common revenue sources include
examination and reciprocity fees, fines, and
state appropriations. Of 31 responding
boards, nearly 84% reported that revenues
were utilized by the board itself; about 6.5%
reported that revenues were utilized by the
state government or legislature.
Board of Pharmacy
and Support Staff
Twenty-five boards reported having a fulltime
executive officer dedicated to the board
of pharmacy, with seven boards reporting an
executive director assigned to the board less
than full time. The number of support staff
utilized by boards of pharmacy varies widely,
with the largest support staff comprised of
43 and no support staff for the smallest.
Thirty-one responding boards reported that
they have administrative staff other than an
executive officer or inspector. Of these,
Nearly 84% reported that revenues were utilized by the board itself;
about 6.5% reported that revenues were utilized by the state
government or legislature.
