Model Act Updated to Address Certain Emergency Waivers,
New Definitions of Pharmacist Care Services, and to
Accommodate Temporary Nonresident Licensure
during a declared state of emergency. To
help facilitate similar needs in the future,
the Model Act was amended to specifically
make allowances for these waivers.
Revisions made to this section include
temporary recognition of nonresident state
licensure and the activation of the NABP
Emergency Passport for pharmacists,
certified pharmacy technicians, certified
pharmacy technician candidates, and
pharmacy interns. The amendments
to this section also included temporary
recognition of nonresident state licensure
for manufacturers, outsourcing facilities,
repackagers, third-party logistics providers,
and wholesale drug distributors.
The most recent amendments to the
Model State Pharmacy Act and Model
Rules of the National Association of
Boards of Pharmacy (Model Act) are now
included in the document available on
the NABP website. The updates include
several changes to account for states
of emergency and other public health
events that may require extra flexibility;
a definition change for " pharmacist care
services " to be more inclusive of the
varied services pharmacists offer; and the
addition of " health care provider " to the
definition of " pharmacist " (along with
corresponding edits to relevant language
in that section) pursuant to Resolution
118-1-22. Updates also addressed the
NABP Emergency Passport for licensees.
State of Emergency Waivers
and Renewal Extensions
In the wake of the coronavirus disease 2019
(COVID-19) pandemic, many boards of
pharmacy waived certain provisions to
allow pharmacists and other pharmacy
staff to better provide health care services
Updated Definitions
The " pharmacist care services " section
in the Model Rules for the Practice of
Pharmacy was updated to account for
the expanding scope of practice for
pharmacists, particularly in relation to
the COVID-19 pandemic. Examples
of services now included in this section
are patient assessment and evaluation,
assessing health plan and medication
eligibility and coverage, prescribing and
administering treatments (including
drugs, devices, vaccines, and biologicals),
and prescribing for emergency use.
Footnotes were also added to clarify
limitations on some of these services
based on state and federal protocols.
In addition, the patient counseling
subsection was updated to clarify that
such activities could be conducted
through remote videoconferencing
software and other forms of electronic
communication, where appropriate.
The definition of " significant adverse
drug reaction " was also updated to include
language suggested by the Alliance for
Pharmacy Compounding (APC) and
approved by the NABP Committee on
Law Enforcement/Legislation and the
NABP Executive Committee. This new
language reflects the definition found
in the Food and Drug Administration
Memorandum of Understanding Addressing
Certain Distributions of Compounded
Human Drug Products. Additional edits
from APC were made, including changes
to compounding sections that were already
enumerated in federal law and suggested
amendments related to compounding
pharmacies, such as an added footnote
that requires pharmacy applicants to
submit responses to a questionnaire
regarding compounding operations.
Prescription Label Requirements
Text was added to the Model Act indicating
that prescription labels should conform
with United States Pharmacopeia
General Chapter <17>, or the most
current chapter addressing labeling of
prescription containers, and all labeling
details that were previously outlined
in the Model Act were removed.
These changes to the Model Act were
incorporated following the NABP Executive
Committee-approved recommendations
made by the Committee on Law
Enforcement/Legislation; the Model Act
Review Committee; the Work Group
to Consider Extending Waivers; the
Overview Task Force on Requirements
for Pharmacy Technician Education,
Practice Responsibilities, and Competence
Assessment; and the Task Force on
Workplace Safety and Well-Being.
