California Permits Operation
of Mobile Units to Dispense
Prescription Medications
Governor Gavin Newsom signed Senate Bill
(SB) 872 - Pharmacies: Mobile Units on
January 1, 2023. Under SB 872, a county,
city and county, or two special hospital
authorities will be allowed to operate a
mobile unit as an extension of the pharmacy
license held. The mobile units will be eligible
to dispense prescription medications (except
controlled substances) under specified
conditions and are required to provide
notification to the California State Board
of Pharmacy 30 days before beginning
use and 30 days before discontinuing use
of a mobile unit. In order for the law to
be implemented, Board staff will develop
a standardized notification process. The
Board's Communication and Public
Education Committee will develop a
document with frequently asked questions
to provide direction on operational issues.
Maryland Expands Membership
of the Board, Authorizes Remote
Prescription-Related Data Entry
and Administration of Vaccines
In April, Maryland Governor Wes Moore
signed House Bill 693 - State Board of
Pharmacy - Board Membership, Delegated
Pharmacy Acts, and Sunset Extension into law.
This bill expands membership of the Maryland
Board of Pharmacy to include one registered
pharmacy technician, authorizes remote
prescription-related data entry by registered
pharmacy technicians and registered pharmacy
interns, and grants administration authority
of coronavirus disease 2019, influenza, and
pneumonia vaccines to registered pharmacy
technicians for individuals ages 18 and over,
and respiratory syncytial virus or shingles
vaccines for individuals ages 50 and over.
Ohio Allows Pharmacists
to Add Drug Delivery
Devices to Prescriptions
Ohio law (4729.391) permits a pharmacist to
modify a drug's prescription to also include
a drug delivery device, if the pharmacist
determines that the device is necessary for
the drug's administration. The State of Ohio

Board of Pharmacy reminds pharmacists that
the device should be added to the existing
prescription for the drug requiring the
delivery device and that the pharmacy should
follow its standard process for amending
prescription records to document the addition
of a device. Furthermore, pharmacists should
use their professional judgment to determine
if adding a new device is appropriate and
necessary for the administration of the drug.

South Carolina Revises Policy #133
OTC Compounding, Requiring
Patient-Specific Prescription to Be
Obtained Prior to Compounding
During its January 2023 meeting, the South
Carolina Department of Labor, Licensing,
and Regulation - Board of Pharmacy
updated Policy #133 OTC Compounding.
After careful consideration of South Carolina
Code of Laws Annotated ยง40-43-86(U),
stating that the dispensing of nonprescription
medications by a pharmacist must be treated
in all respects as a prescription drug, the
Board revised Policy 133 to include the
requirement that a valid patient-specific
prescription must be obtained prior to
compounding, labeling, and dispensing
over-the-counter (OTC) products. Read

Utah Enacts SB 193,
Authorizing Physicians to
Issue Methadone Orders
The Utah State Legislature passed SB 193
during Utah's 2023 legislative session. This bill
authorizes physicians to issue orders regarding
methadone under certain circumstances. Under
Section 58-37-23 of the bill, several terms are
defined, such as " emergency medical order, "
which means a medical order as defined in
Section 58-17b-102 for up to a 72-hour supply
of methadone, and " general acute hospital, "
which means the same as the term in Section
26-21-2. The term " qualified pharmacy "
is defined as a pharmacy that is located on
the premises of a general acute hospital that
is licensed as a class A pharmacy or class B
pharmacy; and the term " qualified practitioner "
is defined as a practitioner who is registered
with United States Drug Enforcement
Administration to issue an emergency
medical order and who works at a general
acute hospital. More information about these
