Binaries

On December 19, 2019, the New York State legislature approved
an amendment to the definition of explosives.
amendment affects a category of products commonly referred
to as " binaries. "
Article 16, Section 451 Definitions, Subsection
1-Explosives

The following sentence amended the definition of an exThe
term " explosives " shall also include two or more components
that are advertised and sold together with instructions
on how to combine the components to create any device
designed or specifically adapted to facilitate a detonation or
combustion.

Products Affected
The following subcategories of binary products are affected:
1.Commercial-use
binaries; and
2.Recreational-use " exploding target " binaries
Compliance
Within the scope of the amendment, both mixed and
unmixed components are defined as explosives. Explosives
in New York State are subject to the applicable provisions of
Industrial Code of the State of New York, Part 39 - POSSESSION,
HANDLING, STORAGE, AND TRANSPORTATION OF EXPLOSIVES
(Code Rule 39).
Affected persons, individuals or businesses who sell, purchase,
possess or come into possession of binaries subject to
the aforementioned amendment are required to obtain applicable
licenses and/or certificates from the State of New York
to be compliant. These may include any of the following:
i. Dealer's License to sell explosives
ii. License to purchase, own and possess explosives
iii. Certificate to store explosives in a magazine
iv. Certificate of Competence to detonate explosives
