INTERVIEW EU Regulations, what’s coming next ? Where are we with the CRD IV - CRR? Negotiators from the Parliament, the Commission and the Council finally came to an agreement over the Capital Requirement Directive and Regulation (CRD IV - CRR) in February. The Parliament (EP) plenary adopted the text in April 2013. The CVA exemption for non-financial counterparties is included. From now on the substance of CRD IV - CRR will not be modified. The Ecofin Council still has to formally adopt the legislation in May 2013. Afterwards, the text will go through legal scrubbing and language review before being published on the Official Journal. It is reasonable to expect that capital requirements rules will be applied as of 1st January 2014. Meanwhile, the European Banking Authority is developing level II legislation, the Regulatory Technical Standards. What other major EU legislations which will be discussed and implemented in 2013? Financial legislation remains high on the EU regulatory agenda for 2013. Level 2 legislation for the European Market Infrastructure Regulation (EMIR) has been developed and entered into force last March. Non-finan- cial companies gained, however, a longer period to get prepared to the new regulatory environment. The Credit Rating Agencies Regulation, approved by the Parliament in January will also be applied in the course of 2013. Discussion on the Market in Financial Instruments Directive and Regulation (MiFID II - MiFIR) is ongoing and an agreement could be reached at the end of the year.
