Day One
ISTAT President Dean Gerber, executive
vice president and general counsel
at Valkyrie BTO Aviation, opened the
first day's sessions by remarking on
the " large shadow that hangs over the
aviation community " with Russia's
invasion of Ukraine occurring just a
week prior. Gerber announced that
ISTAT pivoted the day's programming
to start with a panel discussion about
the Ukraine crisis and its impact on
aviation. " This is a call to arms, " he
said, " and I know the ISTAT community
will rise to the occasion. "
Gerber also reiterated ISTAT's
sustainability commitment and
briefly discussed the May ISTAT
Sustainability Symposium before
moderating the aforementioned Ukraine
crisis panel.
He was joined by Geoff van
Klavaren, managing director of advisory
at IBA Group Limited; Emily Wicker,
partner at Clifford Chance US LLP;
Christopher Beers, chief legal officer at
Aircastle Limited; and Francois Collet,
head of trading at Airbus. Gerber began
by noting that the audience looked to
be " the most packed house we've
had for an opening ISTAT session in
a while. " He continued: " I've seen a
lot of crises, and this one tops them
all. We have a lot more questions than
answers with our panel, but we're
going to try to sort through the chaos. "
van Klavaren detailed the
serious implications for the aviation
industry, including operational issues
for airlines and lessors; negative
implications for air transport demand;
supply chain problems leading to
inflationary pressures; and longerterm
geopolitical consequences.
Ultimately, he said, the recovery of the
industry will continue, but " perhaps
at a slower rate. " He also posited
that there may be " closer [economic]
collaboration between China and
Russia moving forward. "
Wicker focused on the topic
of sanctions and how they affect
leasing. " We strongly recommend
conducting a case-by-case analysis
of potential transactions involving the
lease or movement of aircraft to or
from Russia, Belarus, or the covered
regions of Ukraine to determine
potential U.S. export controls risk

requirements, " she said.
Beers talked about lessor community
reactions and insurance issues, and
Collet discussed Aviation Working
Group's (AWG's) response to the events,
which was to act as a " nerve center to
share information and invite experts to
help us clarify and take action. "
