prosecution in the context of a post-conviction
proceeding until ordered to do so by the Court.
Opinion 10-456 acknowledges that Rule 1.6(b)(5)
permits a lawyer to disclose client information if
the lawyer "reasonably believes [it is] necessary"
to do so in the lawyer's self-defense. However,
even in the context of a proceeding that could end
with the lawyer being found ineffective, the ABA
believes that "it is highly unlikely that a disclosure
in response to a prosecution request, prior to a
court-supervised response by way of testimony or
otherwise, will be justifiable."
Similarly, Comment 21 to Rule 1.6 provides
that, even in the face of a court order, including a
subpoena, unless a client approves disclosure, an
attorney must assert any non-frivolous defenses,
and in the event of an adverse ruling, the lawyer
must consult with the client about the possibility of
appeal. The proscriptive nature of this Comment
in dictating a specific course of action, i.e., motion
to quash or appeal, is problematic as Comments
are advisory and not enforceable. However, the
Comment does state that unless the client agrees
to disclosures, the attorney should resist until
resistance is futile. This Comment and the conflicts
