Grand Jury: ___A.3d. ___ (Pa. 2018); 106 WM
2018; Amicus filed August 2, 2018, case decided
December 3, 2018.
The Pennsylvania Attorney General sought to
release the names and identifying characteristics
of private citizens accused of crimes, but who
were unindicted in the Report of the Fortieth
Statewide Investigating Grand Jury. The
Pennsylvania Supreme Court agreed with one of
the positions argued by PACDL in its brief and
concluded that "...we must make permanent the
redaction of petitioners' identifying information
from [the grand jury report],...as this is the only
viable due process remedy we may now afford to
petitioners to protect their constitutional rights
to reputation."

Commonwealth v. Adams: 200 A.3d 944 (Pa.
2019); 36 EAP 2017; Amicus filed March 2, 2018,
case decided January 23, 2019.
The Pennsylvania Supreme Court considered
"whether a defendant's fugitive status during
the period for filing a notice of appeal-where
his attorney filed a timely notice of appeal
on his behalf and he later returned after the
appeal period ended, but prior to the deadline
for filing an appellate brief-results in the
defendant forfeiting his right to appeal."
The Court concluded that the defendant
forfeited his right to appeal, reasoning that
"when a defendant absconds, and then returns
to the court system, he takes the criminal justice
system as he finds it." If a defendant returns
from fugitive status before the period for filing
an appeal has expired, he/she is entitled to file
