The results of this study reveal that cases
involving a SANE examination are pursued at
higher rates and result in higher rates of guilty
pleas or convictions than those cases without a
SANE examination.26
SANES and the Victims
Sexual violence as defined by the World Health
Organization is "any sexual act, attempt to obtain
a sexual act, unwanted sexual comments or
advances or acts to traffic, or otherwise directed
against a person's sexuality using coercion, by
any person regardless of their relationship to the
victim, in any setting including but not limited to
home and work."27
A multi-country study by the World Health
Organization found the rate of sexual violence by
a partner ranged from 6 percent to 59 percent,
and non-partner sexual violence ranged from .3
percent to 11.5 percent.28 In the study, 3 percent
to 24 percent of participates reported that their
first sexual experience was forced during their
adolescence.29
A study was conducted by Rebecca Campbell
for a report for the U.S. Department of Justice to
determine what victim and case characteristics
could predict case progression through the
criminal justice system.30 The study utilized data
from adult sexual assault cases in a Midwestern
state treated in county hospitals five years prior
to the implementation of the SANE program from
January 1994 to August 1999; and compared those
to cases treated in the local SANE program during
its first seven years of operation.31 The sample
cases fit the following criteria:
* the victim was age 18 or older at the time of
the assault;
* the victim was assaulted within the local
county so that all cases would be processed by
the same prosecutor's office;
* the case was investigated by one of the five
largest police departments in the county;
* a complete medical forensic exam was
conducted by either county hospital
personnel; and
* the exam results were analyzed by the state
crime lab for DNA evidence.32
The study found that younger women between
the ages of 18 and 21 were significantly likely
to have the cases reach a higher dispositional
outcome.33 Alcohol use by a victim significantly
decreased the likelihood that a case would
be prosecuted.34 The more delay between the
crime and when the forensic medical exam was
conducted by a SANE, the less likely the case was
to proceed through the system.35
