he PACDL Rules Committee comments
on rule changes proposed by the various
Pennsylvania Superior Court Rules
Committees. In these comments, we offer
support, objection or suggestions for clarification.
Below are recent proposed rule changes in which
PACDL has submitted a comment.

concrete guidance regarding what circumstances
constituted an "undue hardship" under the
meaning of the rule and the rule not conflate the
terms "prima facie" and "probable cause."
Criminal Procedure
PACDL offered support for the general
sentiment of the rule change that defendants
do not suffer adverse consequences for failing
to pay court imposed financial assessments if
they do not have the financial ability to pay the
assessments.

These proposed rule changes provide for clarity
on the proper rule authority for dismissal of
summary cases when they are on appeal to the
Court of Common Pleas. PACDL supported the
Committee for both clarifying the rule authority
and for hopefully ensuring that, if the relevant
parties can be made whole, that a summary
conviction can be avoided.

These proposed rule changes deal with
limitations on use of hearsay at the preliminary
hearing and clarification following the decision
in Ricker. PACDL expressed support for the

Pa. R. Crim. P. 403, etc. (May 2019)
However, PACDL suggested that the rule
include: (1) that prior to incarceration, the
court has an affirmative duty to inquire into a
defendant's ability to pay and (2) better guidance
regarding which defendants qualify as indigent,
e.g. the rule could include a presumption of
indigence which can then be reconsidered by the
MDJ if appropriate, when a defendant already
has the services of court-appointed counsel, or
if the defendant is receiving means-based public
assistance (such as food stamps, Medicaid, or
Supplemental Security Income).
