Judges Rule on "Disparate Impact" Claims
Eric Luskin, a senior vice president at The Scion Group, recently authored
a white paper that explores how "disparate impact" claims are allowable under
the Fair Housing Act even though those words do not appear in any of the
relevant statutes. "This Supreme Court decision clarifies that the federal Fair
Housing Act (FHA) permits individuals to challenge housing practices that
have the effect of impacting protected classes, even if there is no proof that
anyone intended to discriminate." The full document, which also provides

Potential Changes in the Fair Labor Standards Act
How to account for staff hours according to the Affordable Care Act is an ongoing hot topic for many members. Now, adding
to those payroll guidelines, there could be changes in the Fair Labor Standards Act (FLSA) regarding exempt and non-exempt
employees: specifically, who is and who is not eligible for overtime according to their annual salary. Recently, President Obama
stated that he wishes the annual salary of $50,440 (up from $23,660) be used as the mark for determining who is considered
exempt. According to several members of the ACUHO-I Public Policy Advisory Committee, this could have an impact on
housing and residence life staff, such as hall directors, who are not covered under bargained-for agreements. If the changes in
this act are adopted, they would take effect in 2016.
