BLM Extends Freeze
On Federal Leasing
WASHINGTON-Noting that the
U.S. Department of the Interior is
reviewing the federal oil and gas
program, the U.S. Bureau of Land
Management says it is exercising its
discretion to not hold lease sales in the
second quarter of calendar year 2021.
Independent Petroleum Association
of America Vice President of
Government Relations Mallori Miller
calls BLM's move troubling both in
terms of policy and adherence to the
law. " The Mineral Leasing Act
mandates that quarterly lease sales must
be held, and American oil and gas
producers depend on certainty in the

regulatory process to produce in a safe,
responsible and timely manner, " she
relates. " It is unfortunate that the federal
government has not chosen to uphold its
most basic responsibility and provide
the certainty that is needed. This action
will put jobs on the line. "
BLM notes that DOI's review
originates in Executive Order 14008,
which Biden issued on Jan. 27. It
mandates that " the Secretary of the
Interior shall pause new oil and natural
gas leases on public lands . . . pending
completion of a comprehensive review
and reconsideration of federal oil and
gas permitting and leasing practices in
light of (her) broad stewardship
responsibilities over the public lands . . .
including potential climate and other
impacts. " The order also instructs the
Secretary of Interior to " consider
whether to adjust royalties. "
Wyoming Governor Mark Gordon is
among those panning BLM's decision
to skip a second quarter lease sale as
disappointing but not surprising.

observes. " What is most disappointing
is that DOI could have chosen to review
the federal oil and gas leasing program
while conducting quarterly sales.
Instead, it chose to tighten the financial
choke of revenue that would normally
flow to the state from lease sales, all the
while refraining from consulting with
the very states and communities that are
directly impacted by these decisions. "
According to Gordon, oil and gas
lease sales on federal lands in Wyoming
have provided the state an average of
$35 million a year during the past eight
years. " This year, we have received
zero, because the first and second
quarter lease sales have been
indefinitely postponed, " he reports.
" Wyoming recently filed a lawsuit in the
District Court of Wyoming stating that
the postponement is actually a leasing
moratorium and is contrary to law. " ❒

California's Governor
Moves To Ban Fracturing;
End Oil, Gas Extraction
SACRAMENTO, CA.-Less than a
year after publicly saying his office
lacked authority to ban hydraulic
fracturing in the state, California
Governor Gavin Newsom has directed
the state's Department of
Conservation's Geologic Energy
Management Division to initiate
regulatory action allowing it to stop
issuing new permits for hydraulic
fracturing by January 2024. The
governor also told the California Air
Resources Board to seek pathways to
phase out oil extraction across the state
by no later than 2045.
This move, which the governor's
office calls a response to climate
change, followed shortly after SB 467, a
multifaceted anti-industry bill that
included 2,500-foot setback
requirements and a ban on hydraulic
fracturing, was stymied in the 2021
California State Assembly. Press
accounts note that the governor's
announcement also coincides with a
recall campaign that will require him to
fight to retain his position ahead of the
2022 election season.
The governor mentions he also has
directed CARB to evaluate how to
phase out oil extraction by 2045
through the climate change scoping
