Dealership parts driver suffered 'poisoned work environments'

THE HUMAN RIGHTS TRIBUNAL
of Ontario has awarded $57,904 to a
former employee who was sexually assaulted by her supervisor at a
dealership in Mississauga, Ont. The
award was
"compensation for injury
to dignity, feelings and self-respect resulting
from poisoned
work environments and failure to investigate" her claim,
plus lost wages because she transferred to a lower-paying job after the
attack.
The ex-employee was a parts delivery driver for Cooksville Hyundai
when its parts-department manager sexually assaulted her in 2016.
Two months later, she transferred to
Humberview Volkswagen in Toronto
as a shuttle driver, the June 10 decision said. Both stores belong to the
Humberview Group.
The parts manager pleaded guilty
to assault and was later terminated.
The store has paid the award, according to the ex-employee's lawyer, Saba

"long-standing problem" of Balilaj's
not answering his phone or saying he
was "too busy" to pick up a part or a
customer. The store's review of the
shuttle vehicle's GPS records showed
that it had been "parked in front of
his home for hours at a time," the
decision said. It also said Balilaj
refused to carry out duties required
by the store's revised job description.

The tribunal found adequate evidence of discrimination "flowing
from an unreasonable and inadequate investigation of her complaint." In addition, Cooksville
Hyundai and its human-resources
adviser failed "to properly address
her complaint," including failing to
follow the company's sexual-harassment policies, the decision said.
The former employee "had the
courage to come forward to her
employer to disclose the conduct of
her boss," the tribunal said. "She had
a right to work in a place that was
safe, to be respected and to have her
dignity preserved and a workplace
free of discrimination."
The dealership's lawyer, Inga
Andriessen, declined to comment.

SEX-BIAS EVIDENCE LACKING
THE BRITISH COLUMBIA HUMAN
Rights Tribunal has dismissed a
sex-discrimination complaint by a
Vancouver dealership's sales-loyalty
specialist, finding insufficient proof
that gender was a factor in a change
in her job responsibilities, compensation and later termination.
There was "uncontradicted evidence about her performance issues,"
including not completing customer
deliveries, following up with customers or providing customer service "at
the expected level," the June 2 decision said.
In 2016, MCL Motor Cars hired
Christine Buck-Hutchins, the only
woman in its sales department, the
decision said. The store sells Jaguar,
Aston Martin, Bentley and Land
Rover vehicles.
Buck-Hutchins alleged that the
general manager "created a toxic
work environment and excluded her

SHUTTLE DRIVER DIDN'T DRIVE
AN OTTAWA DEALERSHIP
justifiably terminated a shuttle driver for insubordination and poor work
performance, the Ontario Labour
Relations Board has ruled.
The board found no evidence that
Bytek Volkswagen retaliated against
Altin Balilaj for complaining about
safety and maintenance problems
with his shuttle vehicle. He sought
reinstatement, back pay and $40,000
in damages.
The July 31 decision cited a

from office camaraderie and targeted her for bullying, harassment and
criticism" because of her gender. The
dealership denied any discrimination.
The tribunal said there was some
evidence of "instances of poor treatment" of female employees but said
the general manager had fired three
male sales associates before firing
Buck-Hutchins.

UNION BID IGNORED SISTER STORE
THE LABOUR RELATIONS BOARD
of British Columbia has scotched a
unionization effort at a Richmond
Mini dealership because the proposed bargaining unit didn't include
workers at a nearby BMW store
owned by the same dealership group.
The proposed bargaining unit
would have included service technicians, parts advisers, lot attendants,
service writers and detailers only at
Auto West Group's Mini store and
not at its BMW dealership about 100
metres away. The company is moving both stores into a new building
with separate showrooms.
The board's decision, released
June 11, said employees at both dealerships "have largely similar skills,
duties and working conditions."
The union drive had been
launched by the International
Association of Machinists. - ANC
