Bill Graves, president and chief executive officer of American Trucking Associations, responded critically June 5.
"Given the timing of the release of
this study, it is an obvious attempt to
promote administration policy, rather
than give Congress the unbiased information it requested," Graves said. "It is
appalling that after years of saying the
study would not make recommendations, DOT officials would release this
report - and recommend no change
in current law - just days after the
White House came out opposing truck
productivity increases."

NHTSA Advances
Truck ESC Mandate
The National Highway Traffic Safety
Administration has published a longawaited final rule mandating electronic
stability control, or ESC, systems on
large trucks and buses.
The rule, which gained quick support from the American Trucking Associations, was issued June 3 as Federal
Motor Vehicle Safety Standard 136, to
take effect for new trucks in 2017 -
about six years after the ESC rulemaking
process began.
According to NHTSA, ESC implementation is projected to prevent as many as
56 percent of untripped rollover crashes
involving commercial vehicles.

Bill Aims to Deter
Port Disruptions
A bill aiming to discourage disruptions at U.S. seaports and incentivize
swift resolution of port labor disputes is
being mulled in the Senate.
The Protecting Orderly and Responsible Transit of Shipments (PORTS) Act
of 2015, S. 1519, was introduced June
4 by Sen. Cory Gardner, R-Colo., and
assigned to the Senate Committee on
Commerce, Science and Transportation,
of which he is a member.
The legislation would amend the
present Labor Management Relations
Act, including through granting state
governors intercessory authority currently reserved for the U.S. president.

Crash Mitigation
Systems Urged
The National Transportation Safety
Board is calling for collision avoidance
systems to be standard equipment on
all new commercial trucks and buses, as
well as passenger vehicles.
The recommendation was made in
an NTSB report released June 8 under
the title, "The Use of Forward Collision
Avoidance Systems to Prevent and Mitigate Rear-End Crashes."
"You don't pay extra for your seatbelt," said Christopher A. Hart, NTSB
chairman. "And you shouldn't have to
pay extra for technology that can help
prevent a collision altogether."
NTSB cited National Highway Traffic
Safety Administration statistics indicating collision avoidance systems could
have mitigated more than 1,300 deaths
and 250,000 injuries a year.

Chinese Containers
Won't Face Duties
The U.S. International Trade
Commission has determined that no
antidumping or countervailing duty
orders will be issued on imports of 53foot domestic containers from China.
The ITC ruled May 19 that the
"establishment of a U.S. industry is
not materially retarded by reason
of imports" of the containers, which
the U.S. Department of Commerce
determined in April are subsidized and
sold in the United States at less than fair
value.
