The Fusion of Human Data: A European Essay
of data property. The European Union takes the view that
data are no physical thing which can be stolen. Its sole
nature is being copyable without loss of information. In
fact, European policy makers are expressively in favor of
liberal markets when refusing data property: If the market
shall be liberal, human data shall flow freely too. Again,
liberal markets take priority over the interests of the data
subject. Even if this line of reasoning were followed, a
right to a free copy of one's own human data would be a
remedy to acknowledge the person whose data are used to
make other profits.
Another consideration with little public awareness yet
is extending fundamental rights to a person's mobile devices.
As long as new sensors and actors are being treated as
objects separated from their users, monitoring, quantifying,
and data analysis of man remains what they were in the
20th century: signal intelligence and eavesdropping on signals
for information advantage. On the contrary, ifthe digital
expansion ofman was recognized as new human nature,
the fundamental rights ofman in future could apply explicitly
to his technical assistance too. Provocatively, one could
exclaim " Rights for Cyborgs. " The smartphone and the
chip in the fingertip would be treated similar to cardiac
catheters, artificial hipjoints or implanted hearing aids, and
deemed inseparable part of the human being whose fundamental
rights also extended to them. But the debate about
machines with human properties has only been a woodcut
so far; it may be, though, that future will lead our European
societies away from today's anthropocentric view of the
world to a more robocentric attitude, when machines
appear to become " more human. "
Anyone without ambitions for amending the law to
take into account a new image of man, and anyone who
doubts about this essay's proposition, can still take action.
He is called upon to revive the enlightened image of sovereign
man and to advocate that people are free, even if
such advocacy was against the mainstream opinion. Compared
to the latest visions and claims of a digital and likewise
economic elite, the sovereign man has matured since
ancient times. With a view to the history of Europe in the
20th century, one can say with great conviction: If we
want to experience a future good in many respects, it will
be crucial to hold onto the dignity of man. That is why,
despite spreading ambient intelligence, sovereign man
deserves only the best and most passionate defenders.
