In the upcoming column, I will go
over what is known as patent prosecution-the
process through which
an inventor, or more commonly a patent
professional (patent agent or
attorney) representing the inventor,
drafts and files an application and
then negotiates with the USPTO/
examiner in pursuit of a patent. In
later columns, I will unpack several
of the provisions of the law that I
introduced above.
About the Author
Trishan Esram (trishan.esram@
wilmerhale.com) is a patent attorney
and senior associate with Wilmer
Cutler Pickering Hale and Dorr LLP
(WilmerHale), Washington, DC, USA.
He is admitted to practice in the District
of Columbia and before the
United States Patent and Trademark
Office (USPTO). His legal practice
focuses on patent litigation from presuit
investigations through trial preparation
and support. He also
represents both petitioners and patent
owners in inter partes review
proceedings before the Patent Trial
and Appeal Board at the USPTO. He
works with a variety of technology
clients, including those in the electronics
and engineering sectors. He
joined WilmerHale in 2017 as a Technology
Specialist while attending
Georgetown University Law Center
part time. Prior to his legal career, he
was a Research Engineer at the
Advanced Power and Energy Systems
Department, Pacific Northwest
National Laboratory (PNNL), Richland,
WA, USA. While at PNNL, he
contributed to the development of an
innovative transactive control system
for a smart power grid demonstration.
He also worked as a Senior
Engineer at SolarBridge Technologies,
Inc., Champaign, IL, USA, where
he contributed to the design of a disruptive
micro-inverter for alternatingcurrent
photovoltaic modules. He
received the B.S. degree in electrical
engineering from Northeastern University
in 2003, the M.S. and Ph.D.
degrees in electrical and electronics
engineering from the University of
Illinois at Urbana-Champaign in 2004
and 2010, respectively, and the J.D.
degree in 2021. As part of his undergraduate
program, he was a Co-Op
Hardware Engineer at EMC Corporation,
Hopkinton, MA, USA.
