Getting legal

Compliance incentives
On a case-by-case basis, the EPA has the authority to
reduce or waive penalties for shops or other businesses
that voluntarily discover, disclose and correct their own
noncompliance issues and offer some assurance that
they can prevent future violations. Information about
these self-disclosure programs and other related tools
such as Environmental Audit Protocols, Environmental
Management Systems, Pollution Prevention and more
can be found at the Compliance Incentives Website.
The EPA invites shops to find their own violations
and seek the Agency's advice on fixing the problems.
But violations may also be reported by someone else,
perhaps a customer or competitor. These reports can
lead to either Compliance Assistance or criminal enforcement actions. The EPA may also provide information to local authorities to help them understand their
enforcement responsibilities and to minimize or prevent
violations from occurring at other facilities.
As the rules spelled out in Section 609 were being
written, the EPA recognized that in the end, it's far more
cost-effective to help shops and other businesses comply with the law rather than just prosecute and fine those
that don't. Though the language on their Websites can
be a little intimidating, compliance is mostly a matter of
having the equipment you need to service an A/C system
properly and keeping good records. Take a look at the
Websites and then look at your own business. You may
be surprised at how easy it is to be legal. Contact MACS

The most-often
overlooked rule
Most shop owners simply don't know that they're legally
responsible for informing the EPA of the fact that they
own EPA-approved recovery/recycle/recharging (R/R/R)
equipment. The following information must be mailed to
the appropriate EPA regional office.

Name, address and telephone number of the establishment where the equipment is located

Brand name, model number, year and serial number of the equipment
*
Signature of the person responsible for the equipment.
You can ﬁnd your regional office at http://www2.epa.
gov/aboutepa. Your equipment records must be updated
whenever R/R/R equipment is added to the service facility. The owner of the equipment must also keep copies of
these same records.
