rom open meeting requirements to super liens and the assignment of association fees as collateral for loans, CAI’s Legislative Action Committees (LACs) in Maine, Massachusetts, Rhode Island and Vermont initiated or opposed a range of legislative proposals in the 2009-2010 legislative sessions, and the coming term promises to be equally busy. Here’s a state-by-state summary of what the New England legislative landscape looks like at mid-year.

recommended by the National Conference of Commissions on Uniform Laws. This is the “sister act” to the “Uniform Common Interest Owners’ Bill of Rights” the National Conference also approved. Most of the changes are intended to make condominium governance more professional and more transparent, “and there’s no arguing with that goal, in theory,” says Jon Readnour, a principal in the Vermont law firm, Readnour Associates PC, and member of the Vermont LAC. These are major changes to the way most associations operate, especially recreation properties like we have in Vermont, he says, and in practice many of the new requirements will create significant administrative burdens for association boards and managers without producing essential or significant improvements in association governance. The change that is likely to prove most problematic for the many recreation communities in Vermont, Readnour believes, is a requirement that boards must allow all owners to attend their meetings, giving them sufficient prior notice of the meetings and distributing all meeting-related materials in advance. That is not standard practice now. Complying with those requirements is relatively easy in a residential community where owners live year-round; most board meetings are typically held onsite in a community rec room, notices can be posted on a community bulletin board and meeting materials can be placed in a central location, accessible to all, Readnour says.
