property. Such right generally consists of
posting advertising within the common
areas (something the property should
seek control over within the contract if it
will be permitted) and the right to hold
"marketing events" in which representatives demonstrate the services and sign up
residents onsite.
Some providers, such as Verizon,
are now seeking the additional right to
conduct door-to-door sales, which is
something that each property should
evaluate on an individual basis and decide
whether such sales are appropriate for
their community.
Even if a provider is not willing to pay
a door fee, or the association only wants
to grant non-exclusive rights, there are
benefits to having a service agreement
in place. It may ensure that access to the
property is limited to business hours or
that modifications to the system which
would affect the aesthetics of the common areas are not undertaken without
the expressed permission of the managing
board.
However, communities should not
enter into these agreements without
discussion or in the mistaken belief that
the board must sign the agreement as
presented by the provider. Some of
the solicitation letters sent by providers state that an agreement is necessary
in order for the provider to provide
service at the property. That statement may be somewhat overblown and
misleading.
I have yet to see any cable provider
cancel service to residents because there
is no service agreement in place. In fact,
many properties receive service but do
not have any agreement in place. Having
said that, when a service agreement is in
place, providers may be more responsive
to customers and may make it more
likely that a provider will reinvest in the
property in terms of future upgrades and
improvements. CM
