Committee Update
New Hampshire Condo
Statute Amendments
The New Hampshire legislature
had another busy season when
it comes to association governance. The following is a brief
summary of some of the newest
bills that are becoming law:
n HB 415-In part, this amendment to the statute lessens
the burden imposed by the
undirected proxy limitation
established in 2016 by HB 353.
Now, in associations of 20 or
fewer units, the undirected
proxy limitation is that a person
may not cast a majority of the
votes in the association via
undirected proxies.
n HB 1519-This amendment requires ballots in an association
vote to be counted using a tally
sheet and for the ballots and
tally sheets to be available for a
requested recount immediately
following announcement of
the results. An examination or
recount requires the presence
of one or more board members
and one or more unit owners.
n HB1521-This amendment
defines the term "emergency"
as used in the budget and assessment language established
by HB 353. An "emergency"
is a situation which requires
immediate action due to a
danger related to the structural
integrity of the common areas
or to life and safety or as required by a court order or other
proceeding which could not
have been reasonably foreseen
by the board in preparation and
distribution of the budget.

As a board member, be prepared.
Most questions come from review
of the financials. Board members
are in a position to respond only
if they are familiar with the financials. The board's pre-meeting
review also allows you to address
any potential errors, inconsisten-

Both governing documents and the
Act contain requirements as
to proxies, voting, and the like.
Be sure to comply with applicable
provisions and to save check-in
sheets, proxies, ballots, etc., in
order to be able to verify attendees
and actions taken.
