those witnesses begin to keep a journal relative to the situation. Convincing testimony is specific testimony. So,
while events are fresh, witnesses do
well to write down the dates and times
of incidents, as well as a description of
what occurred.
Another suggestion for litigation
planning is to start controlling communications about the situation.
Associations should bear in mind that
emails are now considered discoverable evidence. So, watch what you
type regardless of who you send it to!
Also, be aware that including anybody
other than the association's attorney
can waive the attorney client privilege
by causing the communication to be
something other than an "attorney
client" communication. Boards should
also be aware that while the amended
Condominium Act in New Hampshire
allows for limited and specific reasons
to hold an executive session, those
reasons do include discussion of
litigation or matters that may become
litigation.
Documents make for great evidence
because they "speak for themselves."
A good "paper trail" can go a long way
towards proving what information was
exchanged between parties and when.

In addition, sending a letter warning
an opposing party that legal action will
occur absent resolution can help to
show that the association acted fairly
in a given situation.
I am also a believer in the old saying
"a picture is worth a thousand words."
Circumstances and events can be documented through photographs prior
to the start of litigation. In fact, the
physical nature of things can change
over time. So, there are instances in
which crucial time periods exist for
taking photographs if the association
is ever going to be able to demonstrate
at a later date precisely what the con-

ditions were on the relevant date.
In sum, while litigation is difficult,
it can usually be seen coming. It can
be made less difficult if associations
prepare good witnesses, are mindful
of emails and communications, create good "paper trails," and capture
photographic evidence during the time
period leading up to the formal court
case.

Unlike some other states,
including Massachusetts,
where legal fees can only shift
in favor of the association
(meaning that the unit
owner could have to pay the
association's legal fees), in
New Hampshire the prevailing
party may have their legal fees
paid regardless of whether the
association or the unit owner
prevails.
