FHA also says that the request
may be denied if: 1) the specific assistance animal in question poses a
direct threat to the health and safety
of others that cannot be reduced or
eliminated by another reasonable
accommodation; or 2) the specific
assistance animal in question would
cause substantial physical damage
to the property of others and cannot
be reduced or eliminated by another
reasonable accommodation. Direct
threats of harm or property damage
must be objective and not "just a
feeling." These provisions apply to
most condominiums.
Direct threats of harm include, for
example, a dog that has bitten someone before. Rhode Island requires
such prior knowledge by experience or
"scienter" before a person can be held
liable to another person bitten within
the unit owner's enclosure (which may
or may not include common areas).

"One Bite" Rule. A board may deny
permission for a dog to come onto
the property, including the unit, or to
continue to stay on the property if that
dog has a proven history of biting.
Some cases around the country
have addressed the issue of property
damage and of private nuisance due
to excessive barking. These cases
indicate that if the assistance dog is
barking excessively and/or destroying
property, then the board most likely
may require the dog owner to implement anti-barking procedures and
devices for their dog. These measures
apply to property damage as well.
In summation, boards in "no pet"
communities should implement specifically tailored rules regarding dangerous animals and animals that cause
property damage, as well as rules
regarding where animals may relieve
themselves and rules mandating pickup. Boards should also specifically
define barking nuisances.
