REGULATION MISGUIDED
THEIR ATTORNEY'S RESPONSE was not what they had
hoped. They learned that their options for adopting and
enforcing their regulation were a lot more limited or difficult
than the board had thought. They were advised that
aside from making a by-law change, they could not enforce their
new policy. In addition, even an amendment to the by-laws to
prohibit pets - if they could achieve 75% of unit owner approval
- would not supersede protections granted under Federal Law
for Service and Emotional Support Animals at the community.

summed it up quite clearly: " We should have spent the few hundred
dollars and consulted with the lawyer before going through
all of these meetings and discussions to avoid spending time on
ideas that in the end turned out to not be legally enforceable. "
Although enthusiastic and well-meaning, the members of
the board of a self-managed community rarely have the training
and experience of a legal professional skilled at handling
community association matters. Boards must reflect clearly on
their responsibility to put the interests of the association at the

forefront in legal matters and to act within their legal authority.
Making good decisions in dealing with governance and operations
issues often requires the insight and expertise of an attorney.
The association's counsel can verify the authority of the
board and delineate its responsibility within the community's
documents as well as under state and federal laws. Crafting
policies that will withstand legal challenges is not a DIY situation.
By finding a legal professional who has the expertise to
help achieve objectives without running afoul of the laws,
board members will avoid wasting their valuable time.
