COMMON AREA SAFETY
BOARD MEMBERS have the
responsibility to ensure that common
areas and facilities are properly
maintained, safety protocols are in
place, and residents are informed of
potential risks and hazards. In essence,
and according to the Massachusetts
Condominium Statute, G.L. c. 183A ยง
10(b)(4), board members are charged
with the responsibility " to conduct
litigation and to be subject to suit as
to any course of action involving the
common areas and facilities or arising
out of the enforcement of the bylaws,
administrative rules, or restrictions in
the master deed. "
One of the primary responsibilities
is to maintain common areas and
facilities. This includes things like
elevators, stairwells, parking lots,
smoke and carbon monoxide
detectors, and recreational areas.
Proper maintenance is essential
to ensure the common areas and
facilities are safe, free from hazards,
and operating in working order.
In addition, regular safety inspections
of these areas should be conducted
to identify any potential safety issues
and address them promptly.
Board members also have a
responsibility to establish safety
protocols to minimize risk and
inform residents of potential hazards.
This includes things like fire safety
procedures, emergency evacuation
plans, warning residents of slippery
or wet floors, informing residents
of potential security threats, and
providing information on how to
safely use equipment and facilities.
These protocols should be clearly
communicated to residents.

BEST PRACTICES FOR MINIMIZING RISK
To minimize risk and promote safety in condominiums, best practices
include, but are not limited to:

Regular safety inspections and maintenance of common areas and
facilities to ensure that the common areas and facilities - such as
the elevators, stairwells, parking lots, and recreational areas -
can be used safely and without hazards.

Regular communication with residents regarding potential risks
and hazards, as well as safety protocols and emergency plans.
Implementation of safety measures during construction or
renovation work, including the use of barriers, warning signs,
and protective equipment.
Regular review of insurance policies to ensure that they
provide adequate coverage for potential risks and hazards.
Creation of a safety committee or task force to oversee
safety issues and ensure that best practices are followed.
