govERNMENT AFFAiRS CArd CheCk legislATion Private Practices: The Employee Free Choice Act almost certainly receive early consideration in the 111th Congress is the so-called “Employee Free Choice Act” ([EFCA] introduced in 2007 as H.R. 800/S. 1041), or “card check” legislation. If enacted, this legislation would amend the National Labor Relations Act to strip workers of their right to a federally supervised private ballot when deciding whether or not to join a union. In place of a private ballot, workers would receive card checks which would allow a union to organize if a majority of workers sign the card. The process is overseen by paid union organizers, not the federal government, and each worker’s choice is ultimately made known to their employer, co-workers, and the union organizers. Adopting such a system would lead to coercion and intimidation of the American worker and should not be tolerated. Additionally, EFCA would mandate compulsory, binding arbitration on the employer and the employees as part of the collective bargaining process. The arbitration provision would have a third-party government official make labor contract decisions that are binding upon both parties.
