S.S. – The Cape Town Treaty, together with the Aircraft Protocol, provides certainty to aircraft financiers regarding their ability to get their aircraft back in a specific time period in the event of a default and when they’re not able to negotiate a return with the customer. The last thing people want to do is repossess their aircraft, but if necessary, Cape Town provides them with the framework and assurances to be able to do so. It also benefits airlines because it creates legal certainty, which reduces risk and enables them access to more sources of financing at lower cost. There are also benefits to governments’ export credit agencies (ECAs). Working through the AWG, Boeing has strongly encouraged the OECD to provide material economic incentives for airlines to urge their countries to adopt the Cape Town Treaty. The ECAs are in a unique position to be able to influence ratification by their governments. The progress we’ve made on ratification so far is predominately a result of the U.S. Ex-Im Bank offering a one-third reduction in their hird r
fees for countries that ratify Cape Town, and it’s been incredibly successful. Q. Where does the ratification process stand? S.S. – As of fall 2010, we have more than 30 countries who have adopted the various aircraft-related declarations and more who’ve signed on to the treaty. The hope we have is to continue to get as many countries as possible around the world to ratify Cape Town. It will do a lot to help encourage more capital to come
into this industry at reasonable rates and reduce the amount of demand for export credit, and the ECAs have to lead the way in this process.
