ou have a client charged with aggravated
assault against a police officer. But your client
isn't simply not guilty - he was a victim. He
was roughly arrested by police for simply using his
cell phone to record a friend's arrest. The arresting
officer writes in his police report that your client
interfered in the arrest and attacked the officer, but
there are witnesses who contradict that. Your client
was roughed up enough to be taken to the hospital
after his arrest. And (because we might as well make
this hypothetical really good) you've heard rumors
that this particular officer has had complaints lodged
against him in the past. You and your client are so
outraged by what happened, that you don't want to
just defend against the criminal charges. You want to
bring an affirmative case against the police. This article
outlines some considerations to keep in mind if you are
representing a criminal defendant who hopes to also
bring a civil rights lawsuit against the police officer
who arrested him.
